TERMS & CONDITIONS

You must be at least 13 years old to use the Service, and at least 18 years old (or the age of majority where you live) to purchase a paid plan. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian. By using the Service you represent that you meet these requirements and that any information you provide is accurate.

You are responsible for maintaining the confidentiality of your username and password and for all activity that occurs under your account. Accounts are for your personal or business use and may not be shared, resold, or transferred without our written consent. Notify us immediately at Packtrackerpro@gmail.com if you believe your account has been accessed without authorization.

We may suspend or terminate an account that violates these Terms, is used unlawfully, abuses the Service or its infrastructure, or creates risk or legal exposure for us.

Pack Tracker Pro lets you log the cards you pull from trading card packs, view running totals, appear on optional leaderboards, and look up estimated card values based on recently observed third-party sales data.

We may add, change, limit, or discontinue features at any time. We aim to keep the Service available, but we do not guarantee uninterrupted or error-free operation.

All values, averages, percentages, and estimates shown in the Service are informational only. They are derived from third-party marketplace data that may be delayed, incomplete, or inaccurate, and they are not an appraisal, offer, guarantee of value, or financial, investment, or tax advice.

You are solely responsible for any buying, selling, trading, grading, or pricing decision you make. If you use the Service to quote prices to customers or to value collections, you do so at your own risk and on your own authority.

You retain ownership of the data you enter, such as card names, sets, notes, and values ("Your Content"). You grant us a limited, non-exclusive license to host, store, process, back up, and display Your Content solely to operate and improve the Service. If you choose to appear on a leaderboard, your username and aggregate pack and hit counts are visible to other users; you can turn this off at any time in your leaderboard settings.

Premium members may optionally use the camera card-scan feature. Photos you take are processed by our AI provider solely to identify the card for your pricing search; they are not used to identify people, and you should only photograph cards — not other people or personal documents. You are responsible for the legality of anything you scan and must not upload anything unlawful, infringing, harassing, or otherwise objectionable.

You agree not to:

• scrape, crawl, or bulk-extract data from the Service or its data sources;
• interfere with, overload, reverse engineer, or attempt to gain unauthorized access to the Service, other accounts, or our systems;
• resell, sublicense, or redistribute the Service or its data as your own product;
• submit false leaderboard entries or otherwise manipulate rankings; or
• use the Service in violation of any applicable law or third-party rights.

Some features may require a paid plan. Prices, billing intervals, and included features are disclosed at the point of purchase. By purchasing, you authorize us and our payment processor to charge your selected payment method for the amounts shown, including applicable taxes, on a recurring basis until you cancel.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are also governed by Paddle's Buyer Terms. We do not store your full card details. Subscriptions renew automatically at the then-current price unless cancelled before the renewal date. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are governed by our Refund Policy.

We may change prices with notice; changes apply to billing periods beginning after the notice takes effect.

The Service links to and relies on third-party services and data sources. We do not control and are not responsible for third-party content, availability, or terms.

Pokémon, TCGplayer, eBay, PSA (Professional Sports Authenticator), CGC (Certified Guaranty Company), and all related names, logos, and marks are the property of their respective owners. References to these companies or services are for identification and convenience only. Pack Tracker Pro is an independent tool and is not affiliated with, endorsed by, sponsored by, or otherwise associated with The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK, TCGplayer, eBay, PSA, CGC, or any card manufacturer, grading company, or marketplace.

The Service, including its software, design, text, and branding (excluding Your Content and third-party marks), is owned by us and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. All other rights are reserved.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that data, prices, or estimates are accurate, complete, or current, or that the Service will be secure, uninterrupted, or free of errors or data loss.

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost collection value, or business interruption, arising out of or related to your use of the Service. Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) fifty United States dollars (US$50).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold harmless Anthony DeSiata and packtrackerpro.com from any claims, damages, liabilities, and reasonable legal fees arising from Your Content, your use of the Service, or your breach of these Terms.

You may stop using the Service and delete your account at any time by contacting us. We may suspend or terminate your access if you breach these Terms or if required by law. Upon termination, your license to use the Service ends; sections that by their nature should survive (including payment obligations, disclaimers, limitations of liability, and indemnification) will survive.

These Terms are governed by the laws of the United States and the state in which the owner resides, without regard to conflict-of-law rules. You agree that any dispute will first be raised informally by emailing Packtrackerpro@gmail.com so we can try to resolve it. If it cannot be resolved, disputes will be brought exclusively in the state or federal courts located in the owner's state of residence, and you consent to that jurisdiction and venue.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide reasonable notice. Continuing to use the Service after changes take effect means you accept the updated Terms.
